Father Fights For Custody Of Child Put Up For Adoption

ATLANTA -- A Forsyth County father says he has spent the past year fighting for custody of his child the mother put up for adoption.

According to the mother's lawyer, the unwed parents began their affair when the girl was 15 years old, saying she was older, and the man was 26, saying he was younger. They produced a baby girl that the mother decided to give up for adoption. The father, George McClintock, has been fighting since she was born to gain custody.Attorneys for the mother of a child born out of wedlock say the father, from Cumming, has no right to decide if the child is put up for adoption or not.

The mother's lawyers and the adoptive parents argue that McClintock has used up his chances to gain custody. After dropping several previous petitions to get parental rights, they say Georgia law prohibits any more.

McClintock's lawyers are arguing that the mother's lawyers violated Georgia law when they failed to notify McClintock of their intentions.

The judge in the case admits the case is complicated and says he will make a ruling soon as to whether the father can continue his custody battle.

George McClintock says, "The State of Georgia is so fast to take child support from a father, but if I want to raise my daughter and be there for her, I have to jump through hoops."

Fate of baby in hands of judge

The question of whether a baby should stay with the adoptive family that has raised her nearly since birth or go to her biological father now lies in the hands of a Forsyth County judge.

Superior Court Judge Jeffrey Bagley heard two hours of arguments Monday morning in the case brought by George McCormick, 29, of Decatur. McCormick has pursued his daughter, born Jan. 5, 2005, through a broken engagement to her biological mother, a would-be adoptive couple in California, and, maybe finally, to would-be adoptive parents in Forsyth County.

Bagley did not indicate when he might rule.

ED: The age issue is a bit creeoy IMO...but it IS his child.
